1. Introduction & Acceptance

Welcome to Study Cabinet ("Snippetz", "the App", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the Study Cabinet application, website, and related services.

By creating an account, using the App, or clicking "I agree" you confirm that you have read, understood, and accept these Terms. If you do not agree, you must not use the App.

These Terms apply to all users regardless of geographic location and are designed to comply with applicable laws in India, the European Union, the United Kingdom, the United States, and Brazil as they relate to your use of the App.

For users under 18: A parent or guardian must review and accept these Terms on your behalf. By allowing a child to use the App, the parent or guardian agrees to be bound by these Terms and accepts responsibility for the child's use of the App.

2. Definitions

"App" โ€” The Study Cabinet application (also called Snippetz), including its website, mobile interface, and all features.

"User" โ€” Any person who accesses or uses the App, including students, teachers, tutors, parents, and coaching centre administrators.

"Student" โ€” A user enrolled in courses, tracking topics, assignments, exams, and using study tools including the EDITH AI assistant.

"Teacher" โ€” A user who manages students, pushes coursework, records grades, and communicates with students through the App.

"Centre" โ€” A coaching centre, institution, or organisation that uses the App to manage students, teachers, classes, fees, and operations.

"EDITH" โ€” The AI-powered study assistant integrated into the App.

"Content" โ€” Any data, text, files, images, or materials uploaded, created, or shared through the App.

"Personal Data" โ€” As defined in the Privacy Policy and applicable data protection laws.

3. Eligibility & Registration

Age: The App is available to users of all ages. If you are under 18 (or the age of majority in your jurisdiction), you represent that a parent or guardian has consented to your use of the App and agrees to these Terms on your behalf.

Registration: To use the App, you must create an account with accurate, current, and complete information. You agree to keep your account information updated.

Parental Consent (under 18): For users under 18 โ€” by accepting these Terms, the parent or guardian confirms they are the child's legal guardian and agree to be bound by these Terms. The parent or guardian is responsible for all activity on the child's account and may request access to or deletion of the child's data at any time by emailing snippetzlabs@gmail.com.

Parental Consent (India โ€” DPDPA 2023): Under India's Digital Personal Data Protection Act 2023, verifiable parental consent is required before processing any child's data. Such consent is obtained during registration when the parent or guardian accepts these Terms on the child's behalf.

Parental Consent (US โ€” COPPA): Under the Children's Online Privacy Protection Act, we obtain verifiable parental consent before collecting personal data from children under 13 (or under 18 where state law requires). Parents may review, refuse, or request deletion of their child's data.

Parental Consent (EU/UK โ€” GDPR): Under GDPR Article 8, for children under 16 (or the age set by individual member states), consent is obtained from a parent or guardian.

One Account Per Person: Each user must have their own account. Account sharing is not permitted.

4. Account Terms

You are responsible for maintaining the confidentiality of your password and for all activity under your account. You agree to notify us immediately of any unauthorised use of your account at snippetzlabs@gmail.com.

We reserve the right to suspend or terminate accounts that violate these Terms, including accounts that are inactive for an extended period, accounts used for illegal purposes, or accounts created through automated means.

You may delete your account at any time through the App's Settings or by emailing us. Upon deletion, your data will be handled as described in our Privacy Policy.

5. Acceptable Use Policy

This Acceptable Use Policy ("AUP") forms part of these Terms and governs how you may use the App. Violations may result in content removal, account suspension, or permanent termination.

5.1 General Prohibitions

You may not use the App to engage in any illegal activity, harass or threaten others, post hateful or violent content, spam other users, distribute malware, attempt to breach security systems, or use automated bots or scrapers without our written permission.

5.2 AI (EDITH) โ€” Specific Rules

EDITH is a study tool. Using it is a privilege, not a right. You may NOT use EDITH to generate content for cheating on exams or assignments, generate abusive or harmful material, attempt prompt injection or jailbreaking, upload explicit content for AI analysis, or automate high-volume requests to degrade service. EDITH outputs may contain errors. You are responsible for verifying any AI-generated content before relying on it academically. Using EDITH to complete assignments for you may violate your institution's academic integrity policies. We disclaim all liability for academic misconduct.

5.3 Teacher Push System โ€” Specific Rules

Teachers may push coursework, grades, and materials to students. You may NOT use the push system to send spam or advertisements, harass students, push unrelated content, push to students outside your assigned class, or send excessive volumes that degrade service. Teachers are responsible for the accuracy of all pushed content.

5.4 File Uploads โ€” Specific Rules

You may NOT upload malware, copyrighted material you do not own, explicit content, files containing others' personal data without consent, or oversized files. If copyrighted material is found, see the DMCA policy in Section 6.

5.5 Centre Chat โ€” Specific Rules

You may NOT use class chat to send abusive messages, share spam, bully others, share contact information without consent, or use chat for non-educational purposes. Teachers and admins may moderate chat.

5.6 Enforcement

Violations are handled proportionally: first/minor infractions receive a warning and content removal; repeated/moderate infractions result in temporary suspension (7โ€“30 days); severe violations or illegal activity result in permanent termination without notice and may be reported to law enforcement. We reserve the right to review, remove, or disable access to any content that violates this policy at our sole discretion.

5.7 Reporting Violations

To report a violation, email snippetzlabs@gmail.com with your name, the nature of the violation, the specific content or user involved, and any supporting evidence. Reports may be submitted anonymously. We will investigate all reports promptly.

6. DMCA / Copyright Policy

Study Cabinet respects intellectual property rights. This policy governs how copyright infringement claims are handled in compliance with the Digital Millennium Copyright Act (US) and applicable international copyright laws.

6.1 Filing a Takedown Notice

If you believe your copyrighted work has been infringed through the App, notify our Designated DMCA Agent with: your physical or electronic signature; identification of the copyrighted work; identification of the infringing material with sufficient detail to locate it (URL, course name, uploader name); your contact information (name, address, phone, email); a statement of good faith belief that the use is not authorised; and a statement of accuracy under penalty of perjury.

6.2 Takedown Procedure

Upon receiving a valid DMCA notice we acknowledge within 48 hours, promptly remove the allegedly infringing material, notify the uploading user, and provide them with information on filing a counter-notice.

6.3 Counter-Notice

If you believe material was removed in error, file a counter-notice with your signature, identification of removed material, a statement under penalty of perjury of good faith belief of mistake, your contact information, and consent to jurisdiction of the Federal District Court for your district (or the Southern District of New York if outside the US). Send to snippetzlabs@gmail.com. If the original complainant does not file a court action within 14 business days, we may restore the material.

6.4 Repeat Infringers

Accounts of users with three or more valid DMCA notices against them, or who have been found liable for copyright infringement by a court, will be terminated.

6.5 Fair Use and Educational Exceptions

As an educational platform, we evaluate takedown notices considering fair use factors: purpose of use (commercial vs educational), nature of the work, amount used, and effect on the market. Content that qualifies as fair use or an educational exception may not be removed.

6.6 International Claims

Copyright claims from outside the US are handled under applicable local law. Please include your jurisdiction-specific legal references when submitting notices.

7. AI Features & Disclaimer

The App includes EDITH, an AI-powered study assistant powered by Groq. The AI generates responses based on patterns in its training data and the context provided. No Guarantee of Accuracy: AI outputs may contain errors, inaccuracies, omissions, or outdated information. You should independently verify any AI-generated content before relying on it for academic, personal, or professional decisions.

No Educational Advice: AI-generated study plans, predictions, and recommendations are suggestions only. They do not constitute professional educational advice, and we make no guarantees regarding academic outcomes.

No Teacher Replacement: EDITH is a supplementary tool and is not a replacement for qualified teachers, tutors, or educational professionals.

Data Processing: AI interactions are processed by Groq Inc. in the United States. By using EDITH, you consent to your prompts and relevant contextual data being transmitted to Groq for processing as described in our Privacy Policy.

User Responsibility: You are solely responsible for the prompts you submit and how you use AI-generated content.

8. Coaching Centre Terms

Coaching centres and their administrators, teachers, and staff agree to the following additional terms:

Centre Responsibility: The centre administrator is responsible for all activity under the centre's account, including actions taken by teachers and staff they authorise.

Data Controller Role: When a centre uploads student data, pushes content, or manages student records, the centre acts as a Data Controller under applicable data protection laws. The centre is responsible for obtaining necessary consents from students and parents, providing their own privacy notice to students, and ensuring lawful processing of student data through the App. A Data Processing Agreement (DPA) is available upon request.

Teacher Management: Centres must ensure all teachers using the App are properly authorised and trained on these Terms.

Accuracy of Data: Centres are responsible for the accuracy of student data, fee records, salary records, grades, and attendance data entered into the App.

Invite Codes: Invite codes are confidential and should only be shared with intended students and teachers. Misuse of invite codes is the centre's responsibility.

Payment Processing: If the centre processes fee payments through the App, additional terms apply. We are not responsible for transactions between centres and their students.

9. Intellectual Property

Our IP: The App, its design, code, branding (including "Study Cabinet" and "Snippetz"), and the EDITH AI system are owned by Pulakit Bararia or our licensors. You may not copy, modify, distribute, sell, or reverse-engineer any part of the App without our written permission.

Your Content: You retain ownership of content you create and upload. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, and process that content solely for the purpose of providing the App's services to you. You represent that you own or have the necessary rights to all content you submit.

AI-Generated Content: To the extent permitted by law, you own the AI-generated content produced through EDITH based on your prompts. However, we make no warranties regarding the originality or copyright status of AI-generated content, and you use it at your own risk.

Feedback: If you provide feedback or suggestions about the App, we may use them without compensation or obligation to you.

10. Limitation of Liability

No Liability for AI Outputs: To the maximum extent permitted by law, we are not liable for any damages arising from your use of or reliance on AI-generated content, including incorrect study material, inaccurate predictions, or academic consequences.

Service Availability: We strive to maintain high availability but do not guarantee uninterrupted or error-free service. We are not liable for downtime, data loss, or service interruptions.

Damages Cap: Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you have paid us in the 12 months preceding the claim, or โ‚น10,000 (or equivalent in local currency), whichever is lower.

No Consequential Damages: In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or academic consequences.

User-Generated Content: We are not responsible for content uploaded by users, including the accuracy, legality, or appropriateness of such content.

Third-Party Services: We are not liable for the actions, content, or failures of third-party services integrated with the App (Supabase, Groq, Google, etc.).

Jurisdiction Variations: Some jurisdictions (including EU member states) do not allow the exclusion or limitation of certain liabilities. In such jurisdictions, our liability is limited to the greatest extent permitted by law. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by applicable law.

11. Termination

By You: You may terminate your account at any time through Settings or by emailing snippetzlabs@gmail.com. Your data will be handled as described in the Privacy Policy.

By Us: We may suspend or terminate your access immediately without prior notice if you breach these Terms, violate the AUP, engage in illegal activity through the App, or if we are required to do so by law. We will notify you after termination where reasonably practicable.

Effect of Termination: Upon termination, your right to use the App ceases immediately. Sections 9 (Intellectual Property), 10 (Limitation of Liability), 11 (Termination), 12 (Governing Law), and the Privacy Policy survive termination.

12. Governing Law & Dispute Resolution

India (DPDPA 2023): For users in India, these Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

European Union (GDPR): For users in the European Union, these Terms are governed by the laws of Ireland. Nothing in these Terms affects your statutory rights as a consumer under EU law. You may lodge a complaint with your local data protection authority.

United Kingdom (UK GDPR): For users in the United Kingdom, these Terms are governed by the laws of England and Wales. You may lodge a complaint with the Information Commissioner's Office (ICO).

United States (COPPA / CCPA): For users in the United States, these Terms are governed by the laws of the State of New York. For California residents, the CCPA grants additional rights as described in our Privacy Policy.

Brazil (LGPD): For users in Brazil, these Terms are governed by the laws of Brazil. You may lodge a complaint with the Autoridade Nacional de Proteรงรฃo de Dados (ANPD).

Dispute Resolution: We encourage you to contact us first at snippetzlabs@gmail.com to resolve any disputes informally. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the jurisdiction that applies to you. Class actions and class-wide arbitrations are waived to the maximum extent permitted by law.

13. Changes to These Terms

We may update these Terms from time to time. When we do, the "Last Updated" date at the top will be revised. Material changes will be notified via email (if available) or in-app notification at least 30 days before taking effect. Continued use after changes take effect constitutes acceptance of the updated Terms. If you do not agree with changes, you may terminate your account before the changes take effect.
